Terms of Service

By creating an account, browsing listings, or otherwise using Vapor Trail (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don’t agree, don’t use the Service.

You must be at least 18 years old and able to form a binding contract to create an account. You’re responsible for the accuracy of your account information, for keeping your password confidential, and for all activity that happens under your account. Tell us right away if you suspect unauthorized use.

Sellers are solely responsible for the accuracy, legality, and completeness of what they list — including pricing, condition, airworthiness status, title, and any regulatory documentation. Vapor Trail is a venue that connects buyers and sellers; we are not a party to, and do not guarantee, any transaction between them. We may remove, edit, or decline to publish any listing at our discretion, including for suspected fraud, prohibited items, or violations of these Terms.

Listing fees, add-ons, and dealer/broker subscriptions are billed through Stripe, our third-party payment processor; we never see or store your full card number. Fees are for the ability to publish or promote a listing on the Service and are non-refundable once a listing has gone live, except where required by law or expressly stated at checkout. Renewals and subscriptions continue until canceled.

You agree not to: post fraudulent, stolen, counterfeit, or illegal items; misrepresent your identity or affiliation; scrape or systematically harvest data from the Service; circumvent fees intended for the Service; upload malicious code; or use the Service to harass another user. We may suspend or terminate accounts that violate this section.

Dealer and broker plans are billed monthly (or annually where offered) and include the listing allowances and features described at the time of purchase. Staff seats added under a dealer account are the dealer organization’s responsibility, including for content those seats publish.

Managed advertising placements are billed at the flat rate agreed with us and, where set up as a recurring placement, are billed automatically via Stripe until canceled. Affiliate/partner links are clearly labeled and reconciled against the partner network’s own reporting, not ours.

The Vapor Trail name, logo, and site design are ours. You retain ownership of content you post (listing text, photos, etc.) but grant us a license to host, display, and distribute it as part of operating the Service.

The Service is provided “as is” without warranties of any kind. We do not guarantee the accuracy of any listing, the airworthiness or condition of any aircraft or part, or the outcome of any transaction between users.

To the fullest extent permitted by law, Vapor Trail is not liable for indirect, incidental, or consequential damages arising from your use of the Service or any transaction conducted through it, and our total liability for any claim is limited to the fees you paid us in the twelve months before the claim arose.

You agree to indemnify and hold Vapor Trail harmless from claims arising out of your use of the Service, your listings, or your violation of these Terms.

You may close your account at any time. We may suspend or terminate access for violation of these Terms. Sections that by their nature should survive termination (fees owed, disclaimers, liability limits) will survive.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

We may update these Terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.
